According to the Center for Disease Control (CDC), nearly one in five deaths in the United States is smoking-related.  In addition, tobacco use results in annual medical costs of over $75 billion.  So, if you or a family member suffers from a smoking-related illness, what can you do?  One increasingly successful option is to file a lawsuit against the tobacco companies.

Your first step should be to consult with a lawyer.  An experienced attorney will be able to assess your case properly, and advise you whether filing a lawsuit is a good idea.  An attorney will also be able to direct you to other resources, such as government programs, that may help you in other ways.

If you do file a lawsuit, expect the case to be a difficult one.  Tobacco companies have a history of aggressively defending themselves against lawsuits.  In fact, the industry went decades before actually losing a case.  However, several plaintiffs have won suits recently, and many people feel that “the tide has turned.”  The Florida Supreme Court even ruled in 2006 that cigarettes are dangerous, tobacco companies are negligent, and smoking causes a variety of cancers and other illnesses.
