Recently, Michigan enacted a law making it illegal for retailers to ship wine to persons within the state. Specifically, wine may be delivered by an employee, but cannot be shipped by a third party. Wine merchants such as Ann Arbor-based Everyday Wines Inc., are worried about the law’s impact on sales. The law has faced criticism from the U.S. District Court, Eastern District of Michigan as well, and seems to conflict with the U.S. Supreme Court, which has held that laws must be equal for in-state and out-of-state businesses.
